Terms & Conditions

NashDesi provides a platform for the Nashville South Asian community, including classified ads, community events, business directory, and related services (collectively, the "Service"). By using the Service, you agree to comply with these Terms & Conditions and all applicable laws and regulations.

If you object to any term or condition, or become dissatisfied with the Service, your only recourse is to immediately discontinue use of NashDesi.

We reserve the right to modify these Terms & Conditions at any time. Changes become effective immediately upon posting. You must review these terms regularly. Your continued use of the Service after changes constitutes acceptance of the modified terms.

You are entirely responsible for all content you post, including classifieds, events, business listings, comments, and any other materials ("User Content"). By posting User Content, you represent and warrant that:

• You own or have the right to post the content
• The content does not violate any laws or third-party rights
• The content is accurate and not misleading
• You will update or remove outdated or inaccurate content promptly

We do not pre-screen User Content but reserve the right to refuse, delete, or move any content that violates these terms or for any other reason, in our sole discretion.

You agree NOT to post content or engage in conduct that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Contains indecent or obscene material
• Discriminates based on race, color, religion, sex, national origin, age, disability, or other protected characteristics
• Violates the Fair Housing Act by stating discriminatory preferences in housing listings
• Violates employment laws by stating discriminatory requirements in job postings
• Impersonates any person or entity or misrepresents your affiliation
• Includes personal information about others without their consent
• Is false, deceptive, misleading, or constitutes fraud or scam
• Infringes intellectual property rights (patents, trademarks, copyrights)
• Contains spam, chain letters, pyramid schemes, or unsolicited advertising
• Advertises illegal services or prohibited items
• Contains viruses, malware, or harmful code
• Posts the same content multiple times or in inappropriate categories

You also agree NOT to:

• Contact users who have requested no contact
• Harass or stalk other users
• Collect user data for commercial purposes
• Use automated tools (bots, scrapers) to access the Service
• Attempt unauthorized access to our systems
• Interfere with the Service's performance or functionality

Housing: All housing-related posts must comply with the Fair Housing Act. You may not state preferences or limitations based on race, color, national origin, religion, sex, familial status, or disability.

Employment: All job postings must comply with federal and state equal employment opportunity laws. You may not state preferences based on protected characteristics unless legally permitted.

The Service may contain links to third-party websites or display third-party content. We are not responsible for third-party content, websites, or services. Your interactions with third parties found through NashDesi are solely between you and them.

You agree to investigate and exercise appropriate caution before proceeding with any transaction with third parties. We have no obligation to become involved in disputes between users or between users and third parties.

While you retain ownership of your User Content, by posting to NashDesi, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, modify, and distribute your content in connection with operating and promoting the Service.

The NashDesi platform, including its design, features, and underlying technology, is protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works without our express written permission.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

We may establish limits on the Service, including maximum posting frequency, content retention periods, or feature access. We reserve the right to modify, suspend, or discontinue the Service (or any part) at any time without notice or liability.

We reserve the right, in our sole discretion, to terminate or suspend your account and access to the Service immediately and without notice for any reason, including violation of these terms. You may also terminate your account at any time.

Upon termination, we may delete your User Content, though we are not obligated to do so.

We may disclose your information and User Content if required by law or if we believe in good faith that such disclosure is necessary to:

• Comply with legal process (subpoenas, court orders)
• Enforce these Terms & Conditions
• Respond to claims that content violates third-party rights
• Protect the rights, property, or safety of NashDesi, users, or the public

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy, completeness, or reliability of any User Content. You use the Service at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NASHDESI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any User Content or conduct of third parties
• Unauthorized access to your account or data
• Any interruption or cessation of the Service
• Any bugs, viruses, or harmful code transmitted through the Service

You agree to indemnify, defend, and hold harmless NashDesi, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another person or entity

Any claim or dispute arising from these Terms or the Service must be filed within one (1) year after the claim arose. These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law provisions.

These Terms constitute the entire agreement between you and NashDesi. Our failure to enforce any right or provision does not constitute a waiver. If any provision is found invalid, the remaining provisions remain in effect.

You may not assign these Terms without our consent. We may assign these Terms without restriction.
